Terms of Service

Welcome to Hit Factor. By using hitfactor.app, Hit Factor Calculator, or Hit Factor Trainer (together, the “Service”), you agree to these Terms. If you don’t agree, please don’t use the Service.

1. The service

Hit Factor is a set of tools for competitive action-pistol shooters, including a score calculator and a training tracker. The Service is operated by MELMAC Network (“we,” “us,” “our”).

2. Accounts

Most features work without an account. For cloud sync, Pro entitlements, and some Trainer features, you’ll need to create an account. You are responsible for keeping your account credentials secure. You must be at least 13 years old (or the age of digital consent in your jurisdiction) to create an account.

3. Hit Factor Pro (in-app purchases)

• Pro features are unlocked via one-time or subscription purchases, processed by Apple, Google, Microsoft, or Snap depending on your platform.
• Prices shown in the app are inclusive of applicable taxes unless noted.
• Refunds are governed by the store where you purchased. We can’t issue refunds directly — please contact the relevant store.
• Pro entitlements are non-transferable between platforms unless explicitly supported by RevenueCat sync.
• If a subscription is canceled or expires, Pro features become unavailable but your locally-stored data remains on your device.

4. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract source code from the apps beyond what is permitted by law.
• Use the Service to harass, threaten, or harm others.
• Attempt to gain unauthorized access to our systems or other users’ accounts.
• Submit spam, malware, or malicious content via the contact form or any other input.
• Use the Service in violation of applicable law.

5. Your content

You retain ownership of the training data you enter into Hit Factor Trainer (attempts, custom stages, notes). By using cloud sync, you grant us the limited right to store and transmit that data on your behalf so the Service can function. We do not use your training data for any other purpose.

6. Classification data

The USPSA classifier library, IPSC course data, and Steel Challenge peak times bundled with Hit Factor Trainer are provided for personal reference. Hit Factor is not affiliated with, endorsed by, or sponsored by the United States Practical Shooting Association (USPSA), the International Practical Shooting Confederation (IPSC), the Steel Challenge Shooting Association (SCSA), or any sanctioning body. “USPSA,” “IPSC,” and “Steel Challenge” are trademarks of their respective owners.

Classification calculations are informational only. For official classification and match scoring, refer to the governing body.

7. Third-party services

The Service integrates with Google Firebase, RevenueCat, Resend, Cloudflare, and the relevant app stores. Your use of those services is also governed by their own terms and privacy policies.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that training data will always be synchronized or preserved without loss. Maintain your own backups if data retention is critical to you.

9. Limitation of liability

To the maximum extent permitted by law, MELMAC Network and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us for Hit Factor Pro in the twelve months preceding the claim, or (b) US $25.

10. Termination

You may stop using the Service and delete your account at any time (Settings → Delete account). We may suspend or terminate your access to the Service if you violate these Terms or if continued operation becomes impractical.

11. Changes to these terms

We may update these Terms from time to time. The “Effective” date at the top reflects the latest revision. Material changes will be announced in the app or via email.

12. Governing law

These Terms are governed by the laws of British Columbia, Canada, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved in the courts of British Columbia.
